Who we are
Employer of Record Kuwait provides employment, sponsorship and payroll services in Kuwait. When we act as the employer of record for your staff, we process employee personal data as part of delivering that service. In this policy, "we" and "us" mean Employer of Record Kuwait.
Data we collect
We collect information you give us directly and information generated when you use our site or services, including:
- Contact details such as name, company, work email and phone number, submitted through our enquiry form.
- Employee and candidate data needed to sponsor, employ and pay staff, such as passport and Civil ID details, nationality, date of birth, educational certificates, salary, bank details and dependants, where you engage our services.
- Correspondence and enquiry details when you contact us.
- Basic technical data such as IP address and browser type, collected through standard web logs.
How we use your data
We use personal data to respond to enquiries, provide and administer our services, apply for and maintain work permits and residency, run compliant payroll through the Wage Protection System, meet legal and regulatory obligations in Kuwait, and improve our website. We process employee data on the documented instructions of the client for whom we act as employer of record, alongside our own legal duties as the sponsoring employer.
Consent and legal basis
We process data where it is necessary to deliver a service you have requested, to comply with a legal obligation, or with your consent. Where consent is the basis, you may withdraw it at any time, though this may prevent us from continuing to provide the service.
Disclosure
We share personal data only where needed to deliver the service: with the Public Authority for Manpower, the Ministry of Interior and the Public Institution for Social Security; with local banks for Wage Protection System payroll; with medical centres and insurers for residency and health cover; and with attestation and translation providers where certificates must be legalised. We do not sell personal data.
Data protection in Kuwait
Kuwait does not have a single general data-protection statute equivalent to those in some other jurisdictions. The principal instrument is the Data Privacy Protection Regulation issued by the Communication and Information Technology Regulatory Authority, known as CITRA, which sets requirements around lawful and transparent processing, purpose limitation, consent, security safeguards, restrictions on cross-border transfer, and notification of data-privacy incidents. The Electronic Transactions Law and the Cybercrime Law are also relevant to how personal data must be handled and protected. Where we process personal data in Kuwait we apply these requirements, and we apply comparable standards of care to data we handle in the course of cross-border service delivery.
Data retention
We keep personal data only as long as needed for the purposes described here or as required by Kuwaiti law. Employment, sponsorship and payroll records are retained for the periods set by the applicable legislation. Enquiry data that does not lead to an engagement is held for a limited period and then deleted.
Security
We use appropriate technical and organisational measures to protect personal data against unauthorised access, loss or disclosure. Passport, Civil ID and payroll data is treated as sensitive, and access is restricted to staff who need it to deliver the service.
Your rights
Subject to Kuwaiti law, you may ask us to access, correct or delete your personal data, withdraw consent, or object to certain processing. To make a request, email us at the address below. We may need to verify your identity before acting on a request.
